As per the appellant, there is a post in front of Syam Complex in the highway itself, which was very close to the building. Instead of taking service connection from the nearby post, the officials of the Licensee inserted an additional post in the property of the Syam Complex and service connection to the complex was taken from the new post. This modification was done without the consent of the appellant. This is a trespassing to the property diverting the entire lines of the premises causing destruction to the property is improper and illegal. On hearing the case, CGRF (Central Region) issued order dated 17-03-2022, stating to rearrange the existing LT lines and the original alignment. Aggrieved by the order of the Forum, the appellant filed the appeal petition to the Authority and the decision is taken as follows: (1) The act of respondent is proper. (2) The respondent shall re-arrange the existing LT lines in such a way that all conductors are to be placed at the same side of the cross arm (northern side) for more convenience to the appellant by maintaining the statutory clearance from the building. (3) The Licensee has to device a proper mechanism to ensure that the officials strictly adhere to the regulations of Kerala Electricity Supply Code, 2014. |

The metering equipment at the premises was covered with vegetation. Earth leakage happened due to the vegetation. The leakage was at the appellant’s side of the installation. Sub Engineer visited the site and inspected the premises and found that the meter is showing high reading though there is no consumption in the construction site. On further testing, it is found that this is due to the earth leakage due to the growth of vegetation. This has been informed to the consumer and the cutout fuse was removed and thus, electricity is disconnected. The bill amount usually came less than Rs.300/-. The respondent issued a bill of Rs.30,000/- and given 5 installments to clear the payment. CGRF had issued order stating that the consumer is liable to pay the amount. Aggrieved by the order of the CGRF(N), the appellant field the appeal petition to the Authority and decision is taken as follows: (1) The appellant is liable to pay the amount as per the consumption. (2) The Licensee shall grant 15 numbers of monthly instalments without interest. (3) CGRF, Northern Region order in OP No.38/2021-22 dated 15-02-2022 is modified accordingly. |

The respondent approached the appellant to convert the temporary stay to permanent, the appellant not permitted them to do so. The temporary stay wire tied to the trees without any consent of the appellant. The CGRF(N) vide order dated 15-02-2022 states that the Forum cannot interfere over a case which is pending before the ADM for property crossing and case is dismissed. Vide order dated 04-04-2022, the ADM, Malappuram ordered to permit KSEBL to install permanent stay wire inside the property of the appellant. Aggrieved by the decision of CGRF(N), the appellant filed the appeal petition to this Authority and decision is taken as follows: (1) ADM, Kozhikode has issued the order as per Section 16 (1) of Indian Telegraph Act 1885 and hence, this Authority cannot interfere. (2) As an alternate technical option, if the appellant construct a compound wall in concrete strong enough, the respondent may tie the stay wire in the hook provided in the concrete compound wall. |
