The appellant is planning to construct a commercial building in this plot. There is one distribution transformer, which was shifted by the Licensee to the frontage of appellant’s property. The transformer with DP structure is inside a fencing which is situated around 2 M away from the boundary of the land. The request has been sent to Section Office, Chottanikkara for shifting the transformer and no action was taken. Then appellant filed complaint to CGRF, Central Region and CGRF (CR) issued order dated 14-10-2022 stating that the transformer is situated at the most suitable position since 8 years and does not cause any hindrance to the entry and exit of vehicles to this property. The appellant filed appeal petition before this Authority and following decision was taken: The appellant may opt for one of the following options: - 1. The appellant may bear the cost of shifting to the proposed location by the side of the Hill Palace Road provided appellant has to obtain more space to house all these structures and existing structure. 2. The transformer has to be shifted to a plinth inside the property of the appellant for which plinth construction and cost of shifting are to be borne by the appellant. 3. Licensee may execute the shifting as per any one of the options selected by the appellant.

The meter reading could not be taken since 10/2021 to 04/2022 due to the door locked condition. When the meter reader attended the premises to take the reading on 04-06-2022 and found that no display was showing in the meter. Then the meter was replaced on 04-06-2022. The next reading was taken on 03-08-2022 and reading shown was 2000 units. Accordingly, the Licensee has raised bill for Rs.18,649/-. The reading was very abnormal and the house was normally in locked condition and they used to be in the house once in a while only. The appellant contented about the abnormal reading and abnormal bill. The appellant complained to check the meter, on checking by the officials of the Licensee, found that the meter was functioning normal. The reason for abnormal reading would have been due to the earth leakage in the wiring. The appellant filed petition to the CGRF (CR) and vide order dated 15-11-2022 states that the petitioner is liable to pay the bill amount. The appellant filed appeal petition before this Authority and following decision was taken: 1. The appellant is liable to pay the bill amount already raised by the Licensee. 2. No further bills on this account are to be issued by the Licensee.

As per the records of the Licensee, the consumer is the owner of the building. The appellant is not supplied with electricity by the Licensee and appellant is only the occupier of the premises when the electricity obtained by the owner of the premises. The status of the appellant has not changed from the “occupier” to the consumer. If the actual consumer is still having any grievance in this particular issue, they can approach the Consumer Grievance Redressal Forum for the resolution. CGRF has wrongly accepted this complaint and heard the same and order issued wrongly. CGRF has to comply with the regulation. The appeal petition filed by the appellant is disposed of accordingly.
