The appellant is a domestic consumer under Electrical Section Muthuvara, Thrissur with connected load 4.633 kW. The appellant installed a Grid interactive solar panel with capacity 3 kW on 25/06/2021. Then the billing have been changed from bi- monthly to monthly. The net metering has been introduced which used to record import as well as export of power. The appellant’s one allegation is about doubling of fixed charge which is not correct. On October 2022 it is found the reading taken from the net meter was inter changed. The export was recorded as import and import was recorded as export while taking the meter reading. Accordingly a short assessment bill was prepared and served to the appellant for Rs. 13,606/-. The appellant have contented the demand and filed petition to the CGRF Central Zone. CGRF issued order dated 23/06/2023 stating that the appellant is liable to pay the short assessment bill. Aggrieved by the decision of CGRF, this appeal petition is filed to this authority.

The appellant is the Managing Partner of Ayyappas Silk House Kottayam and an HT consumer of the licensee with consumer No. 25/491 with connected load 104 kw and contract demand 100 kVA. The appellant was a defaulter in remitting the current charges since May 2020. The country wide lock down was declared with effect from 22/03/2020 and the shop was totally closed. Then the appellant could not pay the energy charges. The licensee has issued a circular stating that no power connection is to be disconnected due to non payment of current charges due to Covid- 19 pandemic. The power was disconnected on 12/02/2021 due to non payment of regular current charges. On 25/02/2021, the appellant has submitted a letter to licensee to discontinue the power supply. The power connection dismantling notice was issued on 31/12/2021. The dismantling period was considered as 6 months from the date of disconnection and accordingly the balance arrears payable by the appellant after adjusting the security deposit was arrived as Rs. 3,06,101/-. The demand notice was issued for the same. The appellant filed petition to the CGRF and CGRF issued order dated 1/08/2023 stating that the appellant is liable to the current charges till disconnection and also the demand charges for 180 days from 12/02/2021. Aggrieved with the order of CGRF, the appellant filed this appeal petition.

പരാതിക്കാരൻ ശ്രീ കെ എൻ മുരളീധരൻ നായർ പ്രസിഡന്റായി ഒരു Ex-servicement Joint Farming Co-operative Society (No. T/294) എന്ന സ്ഥാപനത്തിന് സർക്കാർ 230 ഏക്കർ  സ്ഥലം കൃഷിക്കായി പതിച്ചു  നൽകിയിട്ടുള്ളതാണ്. ഈ സ്ഥലം അംഗങ്ങളായിരുന്ന 112 പേർക്ക് വീതിച്ചു കൃഷിക്ക് വേണ്ടി വിട്ടുകൊടുക്കുകയും അത് പിന്നീട് അവരവരുടെ പേരിൽ പതിച്ചു നൽകുകയും ഉണ്ടായി. ഇതിൽ 5 സെന്റ് സ്ഥലം സൊസൈറ്റിയുടെ പേരിൽ തന്നെ ഒഴിച്ചിട്ടിരുന്നു. പ്ലോട്ടുകൾ വീതിച്ചു പതിച്ചെടുത്തപ്പോൾ joint farming co-operative സൊസൈറ്റി ഇല്ലാതായി. സൊസൈറ്റിയുടെ  പ്രസിഡന്റ് ആയിരുന്നതിനാൽ  ഈ 5 സെന്റും  ഒരു ചെറിയ പുരയും പരാതിക്കാരന്റെ കൈവശം തന്നെയായിരുന്നു. വിതുര വില്ലേജ് ഓഫീസർ ഈ വസ്തു പരാതിക്കാരന്റെ കൈവശമാണെന്ന് കാണിക്കുന്ന കൈവശാവകാശ സർട്ടിഫിക്കറ്റ് നൽകിയിള്ളതുമാണ്. ആ സ്ഥലത്തുണ്ടായിരുന്ന പുരയിൽ വൈദ്യുത കണക്ഷൻ വളരെ മുൻപു തന്നെ വിച്ഛേദിച്ചിരുന്നു. ഇതിന് പുതിയ കണക്ഷൻ എടുക്കുന്നതിനു വേണ്ടി കൈവശാവകാശ സർട്ടിഫിക്കറ്റ് സഹിതം തൊളിക്കോട് ഇലക്ട്രിക് സെക്ഷനിൽ അപേക്ഷ നൽകുകയും CD അടയ്ക്കുകയും ചെയ്തു. ലൈസൻസിയുടെ ഉദ്യോഗസ്ഥർ കണക്ഷൻ നൽകാനെത്തിയപ്പോൾ ചിലർ ചേർന്ന് തടയുകയുണ്ടായതിനാൽ കണക്ഷൻ നൽകാൻ കഴിഞ്ഞില്ല. സെക്ഷൻ അധികൃതർ പട്ടയരേഖയോ ഉടമസ്ഥാവകാശം തെളിയിക്കുന്നതിനുള്ള രേഖയോ ഹാജരാക്കാൻ ആവശ്യപ്പെട്ടു. ഇതിനെതിരെ പരാതിക്കാരൻ CGRF-ൽ പരാതി നൽകുകയും അതിന് 21/08/2023-ൽ വിധി പ്രസ്താവിക്കുകയും ചെയ്തു. CGRF ന്റെ വിധിയിൽ തൃപ്തനല്ലാതെയാണ് പരാതിക്കാരൻ ഓംബുഡ്സ്മാൻ സമക്ഷം അപ്പീൽ പരാതി നൽകിയിട്ടുള്ളത്.
