The appellant Shri. Joseph is the consumer of the licensee with consumer no. 1165087006078 under Puthucode Section Palakkad. In the month of September 2022, the meter recorded a high consumption 2668 units for a period from 1st July to 31st August. There are no high power consuming domestic appliances in the house. The parallel meter was installed and found that the meter was faulty. The appellant states that the meter recorded high reading since November 2021. The licensee has considered the excessive consumption only for 07/07/2022 to 31/08/2022. The appellant requested for revising the bills since November 2021 to August 2022 by averaging the consumption based on the upcoming bills. The appellant filed petition to the CGRF and CGRF issued order dated 31/03/2023. Aggrieved by the decision of CGRF, the appellant filed appeal petition to this authority. On verifying the documents submitted and hearing both the petitioner and respondent and also from the analysis as mentioned above, the following decision are hereby taken. 1. It is concluded that the meter is faulty since November (reading month) 2021. 2. The bill for the month November 2021 to September 2022 is be revised considering the average of consumption of two billing cycles after the meter replacement. 3. The amount overcharged on the consumer by the licensee is to be refunded. 4. No order on cost

The APTS of the Licensee conducted an inspection of the connection on 11th March 2019 and found that this billing was done under wrong tariff. Accordingly, a short assessment bill was raised for Rs.83,045/-. The appellant has requested to change to the actual tariff applicable on 19-03-2021. Accordingly, the tariff has been revised with retrospective effect and bill of Rs.5,98,088/- has been raised by the Licensee. An amount of Rs.3,62,113/- is only interest in the above bill where the principal amount due to tariff difference is only Rs.2,26,975/-. This has been corrected to Rs.5,55,904/-. The appellant objected for changing interest as there is no fault from the consumer and ready to pay the principal amount. CGRF (NR) vide their order dated 30-06-2022 ordered that the appellant is liable to pay interest except the period for which the delay happened from the Licensee. Appellant filed appeal petition to this Authority and the decision is taken as follows: 1) The order of Consumer Grievance Redressal Forum (NR) is set aside. 2) The appellant is not liable to pay the interest for the arrear amount. 3) The appellant has to pay the principal amount without any delay.

The appellant stated that he has received short assessment bill for a period from July 2016 to December 2016 for Rs.41,925/- and a low voltage surcharge bill of Rs.70,510/- for the period from February 2019 to August 2021. On 28-02-2022, the appellant approached KSEBL ‘Adalath Committee’ and the decision was the bills cannot be revised. Then the appellant approached the Consumer Grievance Redressal Forum (CGRF), Central Region and CGRF (CR) vide order dated 23-09-2022 ordered that the appellant is liable to pay these two undercharged bills. Aggrieved by the decision of the Forum, the appellant filed appeal petition before this Authority and following decision is taken: 1. This Authority hereby agreed on the decision of the CGRF (CR). 2. The appellant is liable to pay the short assessment bills as raised by the Licensee.
